The service.
These Terms govern your use of the Goosebumps content tooling — the website, API, and any connected integrations (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Goosebumps is a content-clipping tool that helps you edit, schedule, and publish short-form video to the social platforms you connect. We provide the tooling; you are responsible for the content you upload and publish.
Your account.
You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. You are responsible for keeping your API keys and credentials secure, and for all activity that occurs under your account.
Your content.
You retain all rights to the content you upload. By uploading, you grant us a limited, non-exclusive license to host, process, transform, and transmit that content solely for the purpose of providing the Service to you — rendering clips, generating captions, and posting to the social accounts you connect.
You represent and warrant that you own or have the necessary rights to the content you upload, and that your use of the Service does not infringe the rights of any third party.
Connected platforms.
When you connect Facebook, Instagram, TikTok, YouTube, X, or Snapchat, you authorize us to act on your behalf within the scope of the permissions you grant. Your use of each connected platform is also subject to that platform's own terms. You can revoke access at any time from your account settings or from the platform itself.
Acceptable use.
You agree not to use the Service to:
- Upload, publish, or distribute content that is illegal, hateful, harassing, defamatory, sexually explicit involving minors, or otherwise violates applicable law.
- Infringe the intellectual property rights of others, including posting copyrighted material you do not have permission to use.
- Spam, flood, or otherwise abuse social platforms in a way that violates their terms.
- Attempt to reverse engineer, probe, or interfere with the Service or its infrastructure.
- Resell, sublicense, or otherwise commercialize the Service without our written consent.
We may suspend or terminate access for any violation of these rules.
Fees.
If the Service is offered under a paid plan, the applicable pricing will be presented at the point of purchase. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice for subsequent billing cycles.
Termination.
You may stop using the Service at any time and request account deletion on our data deletion page. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the Service to you becomes commercially unreasonable. Sections intended to survive termination — content license, disclaimers, limitation of liability — will remain in effect.
Disclaimers.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that posts will always publish successfully on every connected platform.
Limitation of liability.
To the maximum extent permitted by law, Goosebumps and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability under these Terms will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.
Indemnification.
You agree to indemnify and hold Goosebumps harmless from any third-party claims arising from your content, your use of the Service, or your violation of these Terms.
Changes to the service or terms.
We may update the Service and these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any disputes will be resolved in the competent courts of Los Angeles County, California, unless applicable consumer law grants you additional rights that cannot be waived.
